These Terms of Service (“Terms”) govern your use of the Stockyard website at stockyardinvest.com, the Stockyard web app and the Stockyard mobile apps (together, “Stockyard” or the “Service”). Stockyard is operated by Accelerare Consultants LLC, a Virginia limited liability company doing business as Stockyard Invest (“we”, “us”, “our”). By creating an account or using Stockyard, you agree to these Terms. If you don’t agree, don’t use Stockyard.

Stockyard provides general, impersonal research tools, data and alerts. Stockyard is not a registered investment adviser, broker-dealer or financial planner, and we don’t provide personalized investment, legal, tax or accounting advice.
Smartfolios, rankings, sector classifications, alerts, prebuilt strategies, AI-generated content and everything else on Stockyard are for information and education only. An alert that a stock meets or no longer meets a set of rules is not a recommendation to buy, sell or hold it. We don’t know your full financial situation, objectives or risk tolerance, and we don’t owe you a fiduciary duty.
Investing involves risk, including the possible loss of all the money you invest. You’re solely responsible for your investment decisions. Consider talking to a licensed financial professional before you invest.
Stockyard doesn’t hold your money or securities, doesn’t have access to your brokerage account, and doesn’t place trades for you. Any trade you make, you make yourself, with a broker of your choosing.
Backtest results are hypothetical. They show how a set of rules would have performed on historical data. They don’t reflect actual trading, and they don’t account for every real-world factor, such as trading costs, taxes, slippage, liquidity or the fact that you might not have followed the rules exactly. Past performance, whether actual or backtested, does not predict or guarantee future results.
Stockyard uses market data, company fundamentals and SEC filings from third-party sources, and uses AI to analyze them. Data may be delayed, incomplete or wrong, and AI-generated summaries and signals can contain errors. We don’t guarantee the accuracy, completeness or timeliness of any data, rankings, classifications, alerts or AI output, and you shouldn’t rely on them as your only source of information.
If you join a club on Stockyard, other members of that club can see the strategies, Smartfolios, leaderboard results and other content you share with the club. Club administrators can invite and remove members. Don’t share anything with your club that you don’t want other members to see.
When you use Stockyard, you agree not to:
Stockyard, including its software, design, data compilations, rankings, sector classifications and content, belongs to us or our licensors and is protected by law. We give you a personal, non-transferable, revocable license to use Stockyard for your own investing research while these Terms are in effect.
You own the strategies, watchlists and other content you create in Stockyard (“Your Content”). You give us permission to store, process and display Your Content to provide the Service to you and, where you choose to share it, to your club.
Stockyard may link to or rely on third-party websites and services, such as data providers, payment processors and app stores. We don’t control them and aren’t responsible for them. Your use of them is subject to their own terms.
Stockyard is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise that Stockyard will be uninterrupted, error-free or secure, or that alerts will be delivered on time or at all.
To the fullest extent the law allows, we won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for any lost profits, trading or investment losses, lost data or loss of goodwill, arising from your use of Stockyard, even if we’ve been told they’re possible.
Our total liability for any claim related to Stockyard is limited to the greater of the amount you paid us in the 12 months before the claim arose, or $100.
Some jurisdictions don’t allow some of these limitations, so they may not all apply to you.
You agree to defend and indemnify us against claims, losses and costs (including reasonable legal fees) that arise from your misuse of Stockyard or your breach of these Terms.
You can stop using Stockyard and delete your account at any time. We may suspend or end your access if you break these Terms, if we’re required to by law, or if we stop offering the Service. Sections that by their nature should survive (including 1, 3, 4, 9, 11, 12, 13 and 15) survive termination.
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Fairfax County, Virginia, and you and we consent to their jurisdiction.
We may update these Terms. If we make material changes, we’ll tell you by email or in the app before they take effect. If you keep using Stockyard after the changes take effect, you accept the updated Terms.
